Terms

Terms of use

The agreement between you and Deskspace. We've kept it as readable as we can — please read it, especially the parts about AI and academic integrity.

Last updated 13 October 2026

1. About these terms

These terms are an agreement between you and Deskspace (“we”, “us”). They apply to the Deskspace website and app, and everything you can do in them (the “service”). By creating an account or using the service, you agree to these terms and our privacy policy. If you don't agree, please don't use Deskspace.

2. Who can use Deskspace

  • You must be at least 13 years old. Deskspace is made for students in Year 9 and above, including VCE and university students.
  • If you're under 18, we encourage you to read these terms with a parent or guardian. A parent or guardian who pays for a plan agrees to the payment terms on the student's behalf.
  • Give us accurate details when you sign up (especially your date of birth) and keep them up to date.
  • Your account is just for you. Keep your password to yourself — you're responsible for what happens in your account. Tell us straight away if you think someone else has used it.

3. Academic integrity — your responsibility

Most schools and universities have rules about using AI, and VCE School-assessed Coursework has authentication rules. You must follow your institution's rules. Deskspace is for learning: model answers and drafts are study material, not work to hand in as your own. Turn on assessment mode for a subject when you're working on graded work and Deskspace will coach rather than write. Your AI use log helps you declare AI use honestly.

We aren't responsible for how you use what Deskspace makes, or for any consequences from your school or university if you break their rules.

4. AI output can be wrong

Deskspace uses AI, which can make mistakes — including stating wrong facts confidently, misreading an upload, or giving a mark your teacher wouldn't. Predicted marks and grades are estimates, not a guarantee of your results. Check anything important against your notes, textbook or teacher.

Deskspace isn't medical, legal, financial or psychological advice, and it isn't a crisis service. If you're in danger or need urgent help, call 000. If something looks wrong, use Report on the output so we can fix it.

5. Your work and uploads

You own what you write and upload (“your content”). You give us a non-exclusive, royalty-free licence to store, copy, process and display your content only as needed to run Deskspace for you — for example, saving it, reading your files, and sending it to our AI provider to answer your request. This licence ends when you delete the content or your account, except for copies in backups that are overwritten in the normal cycle.

We don't claim ownership of your content, show it to other students (unless you post it in a study group), use it for advertising, or sell it.

You promise that you have the right to upload what you upload — your own notes, or course materials you've been given for your own study — and that it doesn't break anyone else's copyright, privacy or other rights. Don't upload other people's personal information unless you need to and are allowed to.

6. What Deskspace makes for you

As between you and us, you can use the notes, flashcards, quizzes, feedback and other output Deskspace makes for you for your own study, however you like — subject to your school's rules (section 3). Because AI output is generated from patterns, similar output may be made for other students, and we can't promise it's unique or that anyone can own it.

7. Our intellectual property

Deskspace itself — the software, design, logo, name, subject guides, prompts and the content we write — belongs to us or our licensors and is protected by copyright and trade mark law. We give you a personal, non-transferable, revocable licence to use the service for your own study while your account is open. Please don't copy, resell, or build a competing service from it.

If you send us ideas or feedback, we can use them to improve Deskspace without owing you anything — thank you.

8. Fair use

Don't use Deskspace to:

  • break the law, or your school or uni's rules;
  • harass, bully or share someone's personal or contact details in study groups;
  • make or share content that's sexual, explicit, hateful, violent or otherwise harmful (study groups block explicit content automatically);
  • try to get around plan limits or safeguards, including tricking the AI into ignoring its instructions;
  • scrape, copy or resell the service or its output in bulk, or use automated tools to access it;
  • reverse engineer, probe or overload the service, or try to access other people's accounts or data;
  • share your account, or sell or give away access to it.

We may remove content, limit features or suspend accounts that break these rules. We'll tell you why unless that would be unsafe or against the law.

9. Plans and payment

  • Prices are in Australian dollars and include GST. The plan's price, what it includes and its limits are shown on the pricing page and at checkout.
  • Payments are processed by Stripe. By paying, you also agree to Stripe's terms, and you confirm you're allowed to use the payment method.
  • Monthly and yearly plans renew automatically, and we charge the payment method on file at the start of each period, until you cancel. Cancel any time in Settings → Subscription; you keep access until the end of the period you've paid for.
  • A semester pass is a one-off payment, doesn't renew, and ends on its stated date.
  • Plans include daily limits on AI requests and a storage allowance. If a payment fails, we retry it for a while; if it still can't be paid, your account moves to the Free plan. Your work isn't deleted.
  • We may change prices. We'll give you at least 30 days' notice before a change applies to you, and it won't apply until your next renewal, so you can cancel first.
  • Except where the law requires (see section 12), payments aren't refundable for partly used periods. If something's gone wrong, contact us anyway — we'll be fair about it.

10. Changes and availability

We're always improving Deskspace, so features may be added, changed or removed. If we remove something important that you've paid for, we'll tell you and offer a fair remedy. We'll give you reasonable notice of changes to these terms that affect you; if you keep using Deskspace after they take effect, you accept them, and if you don't agree you can cancel.

We aim to keep Deskspace running smoothly but can't promise it will always be available or free of errors. It may be down for maintenance, or because of problems with our providers or the internet. Keep your own copies of anything you can't afford to lose — you can download your data any time.

Deskspace relies on third-party services (such as our AI, hosting and payment providers) and links to other websites. We're not responsible for third-party websites.

11. Ending your account

You can delete your account any time in Settings → Your data. That cancels any subscription and permanently deletes your work, so download anything you want to keep first.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we stop running Deskspace. Unless it would be unsafe or unlawful, we'll give you notice and a chance to download your data, and refund any prepaid period we can't provide.

12. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or compensation for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Nothing in these terms excludes, restricts or changes those rights, or any other right you have under law that can't be excluded.

13. Liability

Apart from the guarantees in section 12 and anything else the law doesn't let us exclude, the service is provided “as is”, and we don't make any other promises about it — including that AI output will be accurate or that using Deskspace will get you a particular result.

To the extent the law allows:

  • we're not liable for indirect or consequential losses, lost data you could have kept a copy of, or results you get (or don't) in your studies;
  • where our liability for failing to meet a consumer guarantee can be limited, it's limited to supplying the service again or paying the cost of having it supplied again; and
  • our total liability to you for anything else is limited to what you paid us in the 12 months before the claim (or $50, if that's more).

These limits don't apply to loss caused by our fraud, wilful misconduct or gross negligence.

14. Responsibility for misuse

If you're 18 or over and you break these terms or the law while using Deskspace, you agree to cover reasonable costs we incur because of it (including claims by other people), except to the extent we caused or contributed to them.

15. Copyright complaints

If you think something on Deskspace — such as a post in a study group — infringes your copyright, email help@deskspace.au with what it is, where it is, and why you think it infringes. We'll look into it and remove it if appropriate.

16. Problems and disputes

If something's gone wrong, please contact us first at help@deskspace.au — most problems can be sorted out quickly. We'll try to resolve complaints in good faith within 30 days. If we can't, you can contact your state or territory's consumer affairs or fair trading agency, or take other action available to you.

17. The legal bits

  • Governing law. These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts there. This doesn't take away your right to bring a claim where you live if the law gives you one.
  • Whole agreement. These terms, the privacy policy and anything shown at checkout are the whole agreement between you and us about Deskspace.
  • Severability. If a court finds part of these terms invalid, the rest still applies, and the invalid part is read down as little as possible to make it valid.
  • No waiver. If we don't enforce a part of these terms straight away, we can still enforce it later.
  • Transfer. You can't transfer your account or these terms to someone else. We may transfer them to a business that takes over Deskspace, provided your rights aren't reduced; we'll tell you if that happens.
  • Things outside our control. We're not responsible for delays or failures caused by events we can't reasonably control, like outages at our providers, natural disasters or internet failures.
  • Notices. We'll contact you by email or in Deskspace. You can contact us at help@deskspace.au.
